ETD-TRAVEL immediately notifies the CONSUMER of the changes in the main contract and their effects on the price. In the event that the ETD-TRAVEL CONSUMER is underage, it is obligatory to include information that will enable direct communication with the minor or the responsible person in the place where the minor is staying. 7.5. Before the start of the package tour service, ETD-TRAVEL advises the CONSUMER to insure the costs of returning to the exit point in case of accident and illness, and the costs of treatment and damage arising from all kinds of accidents. 7.6. The consumer must immediately notify ETD-TRAVEL in writing of any deficiencies related to the services specified in the brochure during the performance of the contract. If this deficiency is not remedied, the CONSUMER has the right to demand a reduction in the contract price at the rate of deficiency. 😎 CAUSES OF FORCE MAJEURE: 8.1. In cases of emergency preventing international air, land and sea transportation, in cases of war or mobilization, public uprisings, attacks or terrorist movements, sabotage, in the border neighbors of Turkey or in the countries/cities to be visited within the scope of package tours, at the border gates and/or in the country adjacent to the border gate, including but not limited to riots, occupation and civil war, revolution, insurrection, forced seizure, military coup or seizure of power, civil unrest, industrial disputes, government sanctions, embargo, strikes, lockouts, port closures or occupancy situations or situations that may prevent employees from work. In the event that it is not possible for the CONSUMER to continue the package tour, the ETD-TRAVEL may transfer the contract to a third party who fulfills all the conditions applicable to the package tour, by notifying ETD-TRAVEL in writing or with a permanent data keeper at least seven days before the start of the tour. 9.2. The transferor and the transferee of the package tour contract are jointly responsible for the payment of the counterbalance amount and all additional costs arising from the transfer, provided that it is reasonable and does not exceed the actual cost incurred by ETDTRAVEL. 10-) TERMS AND CONSEQUENCES OF WITHDRAWAL, CANCELLATION AND TERMINATION OF THE AGREEMENT: 10.1. In the event that one of the essential elements of the contract changes before the start of the package tour, the consumer may accept this change or use one of the following optional rights, provided that he/she notifies the change in writing or with the Permanent Data Storage. Participating in another tour of equal or higher value offered by ETD-TRAVEL without paying an additional fee. If the package tour is canceled by ETD-TRAVEL before the start of the package tour due to a reason not caused by the consumer, the CONSUMER agrees to the 10.1. may use the optional rights specified in the article. 10.4. If it is determined that ETD-TRAVEL has not fulfilled or cannot fulfill an important obligation after the package tour has started, ETD-TRAVEL offers alternative arrangements that do not cause additional costs to the CONSUMER for the continuation of the package tour and compensates the CONSUMER for the difference between the services offered and the services offered. The CONSUMER may withdraw from the contract by not accepting the alternative arrangement. In this case, ETD-TRAVEL’s right to charge a fee ends and the payments made are returned to the participant within fourteen days at the latest from the date the contract is withdrawn. However, ETD-TRAVEL may demand an appropriate compensation from the consumer for the actions it has performed up to that point, as long as it benefits from the service. Again in this case, ETD-TRAVEL is obliged to provide free transportation of the consumer to the place where the package tour started or to another agreed place and to cover the expenses incurred in case of compulsory accommodation. 10.5. The CONSUMER has the right to terminate the contract unilaterally, provided that it notifies ETD-TRAVEL in writing or with a permanent data keeper. If this termination is notified at least 42 days before the start of the package tour; Excluding the costs arising from compulsory taxes, duties and similar legal obligations, the price paid is returned to the CONSUMER without any deduction. However, in cancellations If there are fewer than 8 participants, «ETD-TRAVEL» has the right to cancel the tour 20 days before departure. In the event of cancellation from the participant(s) side upto 6 weeks before departure, 30% of the travel sum will be deducted and 70% will be refunded to the participant(s) In the event of cancellation from the participant(s) side upto 3 weeks before departure, 50% of the travel sum will be deducted and 50% will be refunded to the participant(s) In the event of cancellation from the participant(s) side upto 1 week before departure, 70% of the travel sum will be deducted and 30% will be refunded to the participant(s) In case of cancellation from the participant(s) side within 7 days (7th day included) before departure, the full travel sum will be deducted. 10.6. For the consumer or their first degree relatives; Force majeure situations in the laws, severe accidents that prevent the consumer from fulfilling any of the provisions of the ship package tour contract, serious illness requiring treatment, death situations are considered force majeure for the CONSUMER. ETD-TRAVEL cannot be held responsible for the damages arising from the nonperformance of the contract at all or in the event that the breach of contract arises from the following situations: Finding the fault of the CONSUMER. The unexpected and unavoidable behavior of a third party who is not involved in the performance of the contract. Existence of one of the force majeure conditions regulated in article 8 of the contract. The occurrence of an event that ETD-TRAVEL or the independent service provider could not foresee and prevent despite all due diligence. The cancellation of the package tour due to the failure to meet the minimum participation stipulated for the organization and the cancellation of the cancellation has been notified to the CONSUMER in writing or with a permanent data store at least twenty days before the start of the package tour within the period stipulated in the contract. 11.2. In the cases specified in sub-clauses (b), (c) and (d) of article 11.1 of the contract, ETDTRAVEL and its representatives in that location are obliged to quickly assist the CONSUMER in case of difficulties. 12. This Agreement, which has been prepared in two copies between the parties, has been read, checked and accepted by the authorities of the parties together with all its annexes. The parties have accepted and confirmed their commitments and acquisitions, which they have mutually accepted, by signing together. He also accepts and undertakes that all legal responsibility belongs to the persons who will participate in the trip and have signed on behalf of the participant whose names are written in this contract, on behalf of the party accepting this contract. 13. The provisions of the TÜRSAB Kütahya Chart will be taken as the basis for calculating the compensation to be paid in the event that ETD-TRAVEL does not comply with the contract partially or completely. 14. This contract, which is arranged in 12 font size, has been drawn up jointly on behalf of myself and the persons whose names are written below, the final version has been read, accepted and approved by me, and a copy of it with all its annexes has been delivered to me via a written / permanent data storage. Child discounts apply if children stay in the same room with their parents as the 3rd or 4th person. 15.2. Children 0-6 years old may not be given separate beds in hotel accommodation. 15.3. Since there is a seat requirement for children over the age of 2 in transportation vehicles, it is subject to a fee. 15.4. Vehicle changes are reserved according to the number of people. According to the number of people registered for the tour; 8-16 people will be toured by minibus, 17-31 people by small bus, and for more than 31 people by 46-person buses. If a night journey will be made or if the journey time will exceed 4 hours, vehicles with 46 people will be used regardless of the number of people. If there is a participation number that will prevent the tour exit, a vehicle is allocated according to the number of people with the approval of the participants. 15.5. Reservation owners are obliged to follow up and control the belongings with them during the tour, and the agency is not responsible for lost / stolen / lost items. 15.6. The agency has the right to make any changes in the tour program, accommodation facilities, transportation vehicles or cancel the tour, both before and during the tour, due to force majeure or operational reasons. In this case, the reservation owner’s approval is not required, and he or she is not entitled to cancellation or compensation. 15.7. Special warnings and notifications have been made during the contract that the flight time or type of aircraft may change due to reasons arising from the airline company, and it has been accepted by the reservation owner. 15.8. All services included in the price are detailed in the tour program, and other tours and services are subject to an extra fee. Participation is optional, but can only be done if sufficient participants are provided. 15.9. It makes room blockage in accommodation facilities. In this case, the consumer has no right to compensation. 15.18. In case the return conditions are fulfilled, the original invoice must be returned to the agency in order to make a refund after the invoice is issued. 15.19. In installment sales or partial payment options, if the debtor defaults in paying two installments, the remaining debt becomes due. 15.20. The reservation owner accepts and undertakes to pay his debts within the terms specified in this contract. In the event that the debtor defaults in paying his debt, a penalty of 5% of the total reservation amount and a monthly delay interest of 8% will be applied without any warning. (For payments made by card, the rights of the institution in the contract signed by the cardholder with the institution remain.) 15.21. If it is understood that the characteristics (such as age) declared during the reservation of the children who will stay for free or at a discount in accordance with the criteria determined by the facility, are not correct, these children will be paid immediately and fully and all kinds of compensation will be made. 15.22. Pets are not allowed in the transportation vehicles and on the property. 15.23. In the event that the consumer leaves the service on the ground that the type of service he/she has started is defective, he/she has to notify the agency official and the hotel where he/she is staying in writing, together with the reasons, that he/she has left the tour. Otherwise, the consumer is deemed to have abandoned the tour and is deemed to have received and used the service. 15.24. It is the bona fide consumer’s duty of care to notify the consumer of the issues they are complaining about in writing during the performance of the service. The consumer’s use of the service to the end, despite the complaint, eliminates the right to compensation such as replacement service and refund for the issues he complains about. 15.25. The consumer (-s) who do not have a signature in the contract, but who participates in the tour subject to the contract, are also deemed to have read and accepted this contract and committed to it. Despite this, the agency has recourse for the excess amount paid to the consumers who signed the contract against the agency and in case of lawsuits and proceedings related to the trip they have participated in, and if the agency has to pay the consumer a price or compensation other than the ones written in this contract, on the grounds that they do not personally sign the contract. the right is reserved. Even if the consumers participating in this trip have not signed, they have learned the terms of this agreement, which will be valid between the parties, due to the ETD-TRAVEL brochure or ETD-TRAVEL website, and they have accepted and committed to participate in the tour under this contract. For this reason, the consumer has no right to cancel the tour. 15.26. Travel insurance package fees belong to the reservation owners. The scope of coverage for incomplete or defective performance, damage, loss and loss of consumers who purchase travel insurance service or is included in the travel insurance package is determined by the policy of the insurance company providing this service. The agency does not bear any responsibility for the content, scope or application of these guarantees. 15.27. The amount paid by the reservation owner only covers the tour package, tour program and date. 15.28. If there is a conflict between the copy of the contract left by the consumer and the copy left by the agency, the copy records remaining in the agency will be taken as the basis. 15.29. The agency has the right to make any changes in the tour program, accommodation facilities, transportation vehicles or cancel the tour both before and during the tour due to force majeure or operational reasons. In this case, the confirmation of the reservation owner is not required and does not give him the right to cancel or indemnify. Likewise, if it is not possible for the reservation owner to join or continue the tour due to force majeure, it is possible to transfer the reservation to a third party who has all the necessary conditions for the tour. In this case, the transferor and the transferee are jointly responsible for the balance amount and all costs against the agent. 15.30. In Airplane Tours, the Airline Company may change the Flight Direction and Flight Time, depending on the density of the aircraft. ETD-TRAVEL reserves this right by promptly notifying the guests of the change at the time of receipt and arranging the service. Each of our guests participating in the tour is deemed to have accepted the change in advance. 15.31. The amount paid by the reservation owner only covers the tour package, tour program and date. The reservation owner is not affected by possible price changes. 15.32. The parties accept and declare that the addresses and telephone numbers specified in this contract are correct and are valid unless the changes are notified in writing. 15.33. In the event that the agency does not comply with the contract partially or completely, the articles of TÜRSAB KÜTAHYA SCHEDULE are applied in calculating the compensation to be paid.
